This Privacy Policy (“Policy”) explains how BarView LLC (“BarView,” the “Company,” “we,” “us,” or “our”) collects, uses, stores, discloses, and safeguards information when you access or use BarView.com, any related mobile application, and any associated products or services (collectively, the “Services”).

This Policy applies to information we collect:

  1. Through your use of the Services.
  2. Through electronic communications between you and the Services, including email, text messages, and similar communications; and
  3. Through advertising interactions on third-party websites or services, to the extent such advertisements link to this Policy.
  4. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree to this Policy, you must not access or use the Services.

We encourage you to review this Policy carefully to understand our privacy practices. We may update this Policy from time to time in our sole discretion. Changes are effective upon posting, as reflected by the “Last Updated” date above. Your continued use of the Services after any update constitutes your acceptance of the revised Policy, and you are responsible for reviewing this Policy periodically for changes.


1. SCOPE; THIRD-PARTY WEBSITES AND SERVICES

This Policy applies only to information collected through the Services. It does not apply to information collected:

  • Offline or through other means not connected to the Services; or
  • By third parties (including advertisers, analytics providers, social networks, or app stores), even if their content or links are accessible through our Services.

The Services may contain links to third-party websites, plugins, and applications. BarView does not control and is not responsible for the privacy practices of third parties. You should review their privacy policies before providing information.


2. ELIGIBILITY AND AGE RESTRICTIONS

The Services are intended for use by individuals eighteen (18) years of age or older. Certain features, content, or promotions may be restricted to individuals twenty-one (21) years of age or older, where required by applicable law or where the nature of the content reasonably necessitates age-based limitations.

BarView does not knowingly collect, use, or maintain personal information from individuals under the age of eighteen (18). If you believe that personal information of a minor, or of an individual under the age of twenty-one (21) where applicable, has been provided to us, please contact us immediately at support@barviewapp.com, and we will take appropriate steps to investigate and remove such information in accordance with applicable law.


3. INFORMATION WE COLLECT
3.1 Information You Provide to Us (Direct Collection)

We may collect information you voluntarily provide, including:

  • Identifiers and contact information: name, email address, telephone number, postal address (if provided)
  • Account information: username, password (stored in hashed/encrypted form where applicable), profile details
  • Billing or payment information: For venues specifically
  • Age verification information: confirmation of age eligibility
  • User content and submissions: reviews, ratings, comments, listings, photos, messages, and other content you post or upload
  • Customer support communications: information you provide when contacting us (emails, forms, messages)

Important: Information you submit to public areas (reviews, comments, listings, photos, forums) is generally publicly available and may be viewed and shared by others.

3.2 Information Collected Automatically (Usage and Device Data)

When you use the Services, we may automatically collect:

  • IP address and approximate location derived from the IP address
  • Browser type and version, operating system, device type and model
  • Device identifiers and mobile advertising IDs (such as IDFA or Google Ad ID, where applicable)
  • Referring and exit pages, URLs visited, and navigation paths
  • Date and time stamps, clickstream data, pages viewed, and session duration
  • Log files, diagnostic data, and performance information
  • Cookies and similar tracking technologies used to recognize your device or account
3.3 Location Information

Depending on your device settings and permissions, we may collect:

  • Approximate location (e.g., city/state) derived from IP address; and/or
  • Precise location (e.g., GPS) if you enable location permissions within the app (if applicable).

You may control location permissions through your device settings.

3.4 Information from Third Parties

If you connect the Services to a third-party platform (e.g., social media), we may receive information from that platform based on your settings and the platform’s policies (such as name, profile photo, friend/follower lists, or public profile information). BarView does not control third-party platforms.


4. HOW WE USE INFORMATION

We use information for legitimate business purposes, including to:

  • Provide, operate, maintain, and secure the Services
  • Create, authenticate, and manage accounts
  • Enable community features (e.g., reviews, forums, listings)
  • Personalize content, regional listings, and user experience
  • Communicate with you (service messages, account notices, support responses)
  • Send marketing communications where permitted (see Section 6)
  • Conduct analytics, research, troubleshooting, and service improvement
  • Detect, prevent, and address fraud, abuse, and security incidents
  • Enforce our Terms of Use and other policies
  • Comply with legal obligations and respond to lawful requests

We do not sell personal information in exchange for money. We may share information with service providers and advertising partners as described below.


5. HOW WE DISCLOSE INFORMATION

We may disclose information in the following circumstances:

5.1 Service Providers and Vendors

We may share information with vendors and service providers who support our operations (e.g., hosting, analytics, communications delivery, customer support, fraud prevention, marketing services). These parties are authorized to use information only as necessary to provide services to BarView and are subject to confidentiality obligations.

5.2 Advertising and Analytics Partners

We may share non-personal information and identifiers (e.g., device IDs, cookies, IP address, ad performance data) with advertising and analytics partners to:

  • deliver and measure advertising,
  • provide aggregated analytics, and
  • evaluate campaign effectiveness.

BarView does not control how third parties use information once collected through their technologies, and their use is governed by their policies.

5.3 Business Transfers
We may disclose or transfer information in connection with a corporate transaction such as a merger, acquisition, financing, reorganization, sale of assets, or bankruptcy.
5.4 Legal and Safety Reasons

We may disclose information if we believe disclosure is necessary to:

  • comply with law, regulation, legal process, subpoena, or governmental request;
  • enforce our Terms and policies;
  • protect the rights, property, or safety of BarView, our users, or others; or
  • prevent fraud or security issues.
5.5 With Your Consent

We may share information for other purposes with your express consent or at your direction.


6. MARKETING COMMUNICATIONS; OPT-OUT

By creating an account or providing your contact information, you may receive marketing communications (email and/or text) about updates, promotions, events, offers, and newsletters.
You may opt out at any time by:

  • using the unsubscribe link in an email,
  • replying STOP (for text messages where applicable), or
  • contacting support@barviewapp.com

Transactional and administrative messages (e.g., security notices, account verification, policy updates) may still be sent even if you opt out of marketing.


7. COOKIES, PIXELS, AND TRACKING TECHNOLOGIES

We and our partners may use cookies, pixels, web beacons, SDKs, and similar technologies to:

  • keep you signed in and maintain session continuity,
  • remember preferences,
  • understand user activity and improve performance,
  • personalize content and advertising, and
  • measure the effectiveness of ads and communications.

You can disable cookies through browser/device settings. If you disable cookies, portions of the Services may not function properly.


8. THIRD-PARTY ADVERTISING (INCLUDING GOOGLE)

The Services may include third-party advertising, including Google. Third-party vendors may use cookies or similar technologies to serve ads based on your activity across websites and applications.

BarView is not responsible for third-party advertising practices. You can manage ad personalization through the provider’s controls (e.g., Google ad settings) or device settings.


9. PUBLIC CONTENT AND USER SUBMISSIONS

If you submit content to public areas of the Services (reviews, comments, listings, images, forum posts), that content may be publicly visible and searchable. BarView does not guarantee confidentiality for public submissions.
BarView may remove content at its discretion if it violates our Terms, policies, or applicable law.


10. DATA SECURITY

We implement commercially reasonable safeguards designed to protect information. However, no security measure is perfect. Transmission over the internet is not fully secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your login credentials and for any activity occurring under your account.


11. DATA RETENTION

We retain information as long as reasonably necessary to:

  • provide and improve the Services,
  • comply with legal obligations,
  • resolve disputes, and
  • enforce agreements.

Retention periods vary depending on the nature of the information and legal requirements.


12. YOUR PRIVACY RIGHTS AND CHOICES

Depending on your location and applicable law, you may have rights to:

  • request access to your personal information,
  • request correction of inaccuracies,
  • request deletion of certain personal information,
  • request portability (where required), and
  • opt out of certain processing activities (where applicable).

To submit a request, email support@barviewapp.com. We may require identity verification and may deny requests as permitted by law. We will not discriminate against you for exercising your rights.


13. CALIFORNIA NOTICE (CCPA/CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act as amended (CCPA/CPRA), including the right to request information about our collection, use, and disclosure of personal information.
You may request information about our disclosures for direct marketing purposes (if any), once per calendar year, by contacting support@barviewapp.com


14. OTHER STATE PRIVACY RIGHTS

Residents of certain U.S. states may have additional privacy rights, including the right to:

  • confirm whether we process personal information,
  • access, delete, or obtain a copy of personal information, and
  • opt out of certain processing for targeted advertising (where applicable).

Camera User and Venue Responsibility Disclaimer
  1. User Responsibility for Actions
    All individuals, guests, patrons, or users present at the Venue (“Users”) are solely and fully responsible for their own behavior, actions, and conduct at all times. The Company assumes no responsibility or liability for the actions, decisions, or misconduct of any User before, during, or after any event or service provided.
  2. No Monitoring or Data Collection
    The Company does not monitor, control, record, or collect any information from cameras, surveillance systems, or visual recording devices located at the Venue. Any cameras, security systems, or visual monitoring equipment present at the Venue are owned, operated, and controlled solely by the Venue and its representatives.
  3. No Liability for Visible Conditions or Events
    The Company shall not be held liable for any incidents, damages, losses, injuries, or claims arising from or related to anything visible, captured, or not captured on any camera or surveillance system at the Venue. The Company has no responsibility for monitoring activities, security conditions, or events occurring within the Venue.
  4. Venue Assumption of Responsibility
    The Venue acknowledges and agrees that it retains full and exclusive responsibility for all security, surveillance, and monitoring of its premises. The Venue shall be solely responsible for any claims, disputes, or liabilities arising from events occurring on the premises, including those that may be visible on any camera or to any individual.
  5. Indemnification
    The Venue agrees to indemnify, defend, and hold harmless the Company, its owners, employees, contractors, and affiliates from and against any and all claims, demands, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:
    1. Any incident occurring at the Venue;
    2. Any information visible or not visible on Venue cameras;
    3. The Venue’s security practices or lack thereof;
    4. Any attempt to hold the Company responsible for events beyond its control.
  6. No Claims Against Company
    The Venue expressly agrees that it will not pursue any legal action, claim, or demand against the Company related to visibility, surveillance, security conditions, or any occurrence within the Venue. All such responsibility remains exclusively with the Venue.
  7. Acknowledgment
    By entering into this Agreement, the Venue acknowledges that the Company provides no security, surveillance, or monitoring services and assumes no responsibility for any events occurring on the premises.

User Conduct and Venue Authority
  1. User Responsibility for Actions
    All individuals, guests, patrons, or users present at the Venue (“Users”) are solely and fully responsible for their own behavior, actions, and conduct at all times. The Company assumes no responsibility or liability for the actions, decisions, or misconduct of any User before, during, or after any event or service provided.
  2. Venue Control Over Users
    The Venue retains full and exclusive authority to manage, discipline, remove, refuse service to, or otherwise address any User in any manner the Venue deems appropriate. The Company shall have no duty or obligation to intervene in User conduct or disputes and shall not be held responsible for any action or inaction taken by the Venue with respect to any User.
  3. No Liability for User Conduct
    The Company shall not be liable for any claims, damages, injuries, losses, or disputes arising from:
    1. The conduct, negligence, or intentional acts of any User;
    2. Decisions made by the Venue regarding admission, removal, or treatment of any User;
    3. Interactions between Users and Venue staff, security, or other third parties.
  4. Venue Assumption of Responsibility
    The Venue acknowledges and agrees that it bears full responsibility for enforcing its own rules, policies, and legal obligations with respect to Users. The Venue further agrees that any disputes, incidents, or legal claims involving Users shall be handled solely by the Venue and not by the Company.
  5. Indemnification Related to Users
    The Venue agrees to indemnify, defend, and hold harmless the Company from any and all claims, liabilities, or expenses arising from the actions of any User or from the Venue’s handling of any User, including removal, discipline, or refusal of service.
  6. Acknowledgment
    The Venue expressly acknowledges that the Company does not supervise, control, or assume responsibility for Users and that all User-related matters remain under the Venue’s sole discretion and authority.

15. CHANGES TO THIS POLICY

We may update this Policy from time to time. Updates will be posted with a revised “Last Updated” date. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Policy.
For material changes, we may provide notice through the Services, by email, or other reasonable means.
